KSCIE January 2021 update

An update has been made to Keeping Children Safe in Education (2020) to take account of changes to recruitment after the UK left the EU (see below). The latest version can be downloaded here: Keeping children safe in education (2020) Update – January 2021 (Post EU Exit)

In terms of sharing with staff, I think the change is minimal and most staff won’t need to have updated copies or anything later that. However, as the change involves recruitment, I suggest that you inform senior leaders, governors, and office staff who deal with recruitment or the single central register. For this group of people I would record somewhere that you have communicated the change, either individually or via a meeting minute.

KSCIE January 2021 update

This guidance replaces Keeping Children Safe in Education September 2020. Changes are strictly limited to those related to the UK leaving the EU on 31 December 2020.

European Economic Area (EEA) regulating authority teacher sanctions or restrictions

149. From 01 January 2021 the TRA Teacher Services system will no longer maintain a list of those teachers who have been sanctioned in EEA member states. Advice about how information about a teacher’s past conduct may be obtained can be found at paragraph 172.

172. …schools and colleges must make any further checks they think appropriate so that any relevant events that occurred outside the UK can be considered. These checks could include, where available:
 
  • criminal records checks for overseas applicants – Home Office guidance can be found on GOV.UK; and for teaching positions
  • obtaining a letter of professional standing from the professional regulating authority in the country in which the applicant has worked. Advice about which regulatory or professional bod applicants should contact is available from the National Recognition Information Centre for the United Kingdom, UK NARIC.

The staffing and employment guidance has also been updated to reflect legal changes following EU exit. I have only looked at the document from a safeguarding point-of-view, but could only find the EEA check removal as discussed above.

Staff Wellbeing Poster (Anna Freud Centre)

Mental health charity has developed 'ten ways to support school staff wellbeing'. The resource provides some helpful materials and encourages schools to reflect that if they want to make a success of promoting children’s mental health, this can only be achieved by giving the staff wellbeing the consideration it deserves.

Recording live lessons

The recording of live lessons for safeguarding purposes continues to evolve. In the absence of statutory guidance, schools must decide for themselves on the basis of risk. I've put together a suitable starting point for such a risk assessment.

NEW! Safeguarding Course for Governors - Can you help?

Schools issued formal reprimand by ICO (Hill Dickinson)

Whilst thinking about data protection law, particularly around the use of images and children’s personal data, this article by lawyers Hill Dickinson is useful reading. In March 2020, the Information Commissioner’s Office (ICO) reprimanded two separate schools over their processing of children’s photographs.

In the first, parents of a primary child had stated on the consent form used by the school that images taken were not to be used ‘outside of school’. When a class photograph was taken, a proof was sent home to all parents for them to preview. The parents considered that this picture was sent 'outside the school'. The ICO said that the school had failed to implement an appropriate procedure for the handling of pupils’ images.

The second reprimand was been issued to a primary school when they shared a class photograph with the local media. Parents of two pupils had not given consent for the image to be used in this way.

The ICO found that in both cases, the principles under Article 5 GDPR had been infringed. In particular, the schools had failed to implement an appropriate procedure for the handling of pupils’ images and had failed to report the breach to its Data Protection Officer (‘DPO’) or the ICO.

Let's Talk About Porn (SWGfL)

Young people's access to pornography has never been easier. And the type of material is much more 'adult' than ever before. At one time, easily available pornography was about nudity, today every type of activity can be found - some of it illegal.

The South-west Grid for Learning have created 'Let's Talk about Porn', a teaching resource designed to help educate young people about pornography. Created by the lead practitioner for the Professionals Online Safety Helpline, Carmel Glassbrook, the resource has been developed over a couple of years in response to the need from schools and teachers to have something that can help with the growing issue of pornography consumption in teenagers.

The authors say that the resource is intended for Key stage 3 as they feel that year 9 in the UK is a good age for this lesson. Many parents will be alarmed to know that research shows that children of this age have already been exposed to or be a regular consumer of online pornography.

As with all topics of this nature, care needs to be taken to ensure that the material has been previewed by staff and is carefully fitted into the curriculum approach for the school and its community.
